Introduction

Your privacy and our obligations to you around our collection and use of your personal information are important to Princess Pictures and its affiliated, subsidiary and related entities (“Company, “we”).

This policy explains the purposes for which Company may collect, use and disclose personal information, the types of personal information that Company may collect, who information may be collected from, how personal information can be accessed, how individuals can access or update their personal information, and what to do if you have a complaint about our handling of personal information.

Company is committed to respecting your privacy and to our compliance with the Australian Privacy Principles in the Privacy Act 1998 (Cth).

Why do we collect, use, hold and disclose personal information

Company collects and uses personal information for the purposes reasonably necessary to carry out the activities connected with the planning, development, production, distribution, broadcast and exhibition, and promotion of Company’s production(s) or other productions.  This may include collecting personal information for the following purposes:

  • to assess the suitability of persons for engagement in a film or television production or to be otherwise involved with the Company’s productions, including for on-screen roles or as crew, during development, production or marketing of our productions;

  • if applicable, for inclusion in the Company’s productions, including in the case of on-screen roles for cast and crew, providing screen and advertising credits;

  • to provide information to you such as newsletters, press releases, updates on certain productions;

  • for day-to-day administration of our business as a production company, including if necessary to answer enquiries;

  • to resolve a complaint;

  • to apply for and maintain insurances for cast and crew on a film or television production;

  • to carry out our obligations to investors, financiers, broadcasters, distributors and other licensees of our film and television productions including applying for tax rebates and incentives, such as the Producer Offset;

  • to satisfy pre-conditions of employment or engagement, workplace health and safety policies and legal requirements relevant to our work in the film and television industry;

  • for the safety and security of Company personnel and others involved in Company’s productions.  For example, protecting and ensuring workplace health and safety, including as necessary to prevent the spread of COVID-19 at Company’s workplaces in accordance with Company’s COVID-19 protocols.

When we collect personal information

We collect personal information from you when you:

  • are involved in a project being submitted to us (Note that we will not accept any unsolicited project submissions);

  • make contact with us and disclose your personal information;  

  • enquire about or apply to be involved in one of our productions;

  • apply to participate in one of our productions in any other way, such as an on-screen participant, in crowd scenes or in any viewer interaction or in any competition related to our productions;

  • are otherwise associated with the development, finance, production and marketing of one of our productions;

  • provide feedback about our productions or our other activities; 

  • buy our productions and/or related material, such as merchandise or purchase the right to view our production or a special offer related to such production;

  • provide services or are otherwise involved in one of our productions;

  • contact us by phone, email, writing or via our website or social media with an enquiry, complaint or feedback;

  • provide health related information to us including for example, your COVID-19 vaccination status or COVID-19 test results;

  • are involved in any on-set or workplace related medical issues;

  • enter or are at a Company workplace when necessary to ensure workplace health and safety, including to prevent the spread of COVID-19 at that workplace;

  • might otherwise reasonably expect from our conduct that we are collecting that information.

We may also collect your personal information from third parties (see following paragraph “How we collect personal information”).  

You do have the right to contact us and deal with us anonymously or by using a pseudonym, however in some such situations it may be impractical for us to deal with you or provide you with the assistance you request.  

How we collect personal information

We may collect personal information in person, from information you provide (including in contracts and job applications), by phone, by email, online though social media platforms and via our website, via video or other recordings.

We may also collect personal information about you that has been provided through third parties, including from:

  • participants in or contributors to our productions, including production partners or any co-producers or distributors;

  • individuals, companies and agencies, relating to pre-employment checks including Working with Children Check and police checks;

  • casting and talent agents and managers;

  • parents and guardians and schools, in the case of minors appearing in our productions including in relation to obtaining applicable pre-employment child permits and consents, or for example, students undertaking work experience,

  • contractors that supply services to our productions;

  • funding bodies, financiers and licensees associated with our productions; from funding bodies, financiers, broadcasters and licensees associated with the production;

  • advertisers and promotional partners;  

  • insurance companies handling Company’s insurances.

What personal information do we collect?

Personal information is information about you that identifies you or might identify you. The information that we will collect depends upon the reason we seek it or the reason you provide it to us. Personal information that we may collect about you may include any or all of the following:

  • name, contact details including address, email and phone numbers, your date of birth, your next of kin/emergency contact;

  • work history, biographical details (including qualifications and skills), driver’s licence details and other permits or licences relevant to your role;

  • ABN, bank account details, superannuation information;

  • country of residency and citizenship and passport information;

  • photographs, details of physical characteristics and body measurements (e.g., if applicable for wardrobe requirements)

  • audio and/or visual recordings (including rehearsals and outtakes) in accordance with the applicable cast, participant or crew agreement;

  • information which you have provided in connection with your social media accounts through your interactions with us on social media, for example Facebook, Twitter, Instagram or YouTube.

When you apply for a job or seek an on-screen role we may also obtain additional personal information such as biographical information, citizenship and residency, gender identity, appearance and physical characteristics (including photographs).

Company may collect information on the diversity of the people it engages on its productions for funding, compliance or reporting purposes. This information may include but not be limited to ethnicity, gender, sexuality, disability.

Sensitive Information

 

Some of the information we collect from people involved on our productions may be sensitive information including medical history and other health information, also racial or ethnic origin, membership details of any unions, trade associations or guilds, and clearances for “Working With Children” or police checks.  

Health and other sensitive information may need to be collected from personnel to ensure we can deal with any on-set medical issues, allergies or dietary issues for catering purposes, compliance with engagement conditions, Company insurance requirements, workplace health and safety policies and and/or as required by law, regulation or government health order.

Other sensitive information may be required to determine whether personnel have a criminal record (for example, if required for an individual to work with children or for any overseas visas or work permits).

We will only collect the minimum amount of sensitive information about you that we consider necessary, with your consent and directly from you, or if you consent to us collecting that information from a third party, unless in some circumstances an exception applies at law. 

 

COVID-19: People working in the film and television industry may be required to provide their vaccination status. People may also be required to undertake a COVID-19 test and provide satisfactory evidence of a negative COVID-19 test result before entering the workplace and from time to time at the workplace, if they work outside their home, including on location.  This applies to employees, volunteers and contractors and in some cases, to visitors to the workplace.  If you refuse to provide this information where required, you may not be permitted to enter or remain on our workplaces. The holding and storage of personal information

We seek to keep your personal information safe and secure, whether it be as a hard copy or in an electronic format. We only allow authorized personnel to access personal information.   

We store personal information electronically on computers which are password protected. We may also store private information electronically via Google Drive which are also password protected. We store hard copy materials at our primary office and in a secure off-site location.

We will destroy, delete or de-identify personal information which is unsolicited and is not necessary for us to carry out our activities and provided we are not required to retain that information by law. We employ secure destruction procedures when hard copies of documents containing personal information are no longer required by us. 

We require our staff and production personnel, including independent contractors, to protect the personal information that they may handle in accordance with this Policy.

If you commence work with us as an employee, personal information including health information collected and related to your employment relationship with us, including information already provided to us as part of any pre-employment process, will then be held as an “employee record” which are exempt from the Australian Privacy Principles.   However, we do endeavour to deal with employee records on the same basis as other personal information under this Policy.

COVID-19: In all cases, COVID-19 and related health information will be stored securely and will only be disclosed to persons on a “need to know basis” within or outside the Company group as necessary, including to assist us with the compliance, prevention and management of COVID-19 and health and safety in our workplace.

Who do we disclose personal information to?

Company will not disclose your personal information to third parties except (i) as set out in this Policy; or (ii) for the particular purpose for which the personal information was collected; (iii) with your consent; or (iv) otherwise permitted or required by law.

We may disclose personal information to third party service providers engaged by Company such as a casting agent or manager, an accounting, pay-roll or disbursement company, or other third party contractors (including its employees) engaged on a Company production.

We may disclose personal information to our investors and financiers, broadcasters, our insurers including completion bond companies, our sales agents and distributors, and travel agents. Some of these third parties may be located outside Australia.

Some government funding departments and agencies require aggregated details relating to a production, including for example employee or contractor nationality and residency information (including details of state of residence).

Some government agencies may also require personal information about Company’s cast and crew, including details of engagement and payments received in order for Company to access tax rebates (such as the Producer Offset) and production incentive funding arrangements. 

Company may ask for consent to provide cast and crew conduct details to organisations involved in Surveys and reporting (for example, The Everyone Project or TEP, an online platform measuring and reporting on demographics of cast and crew in the Australian film and television industry).

Personal information of cast engaged on our productions may be provided to the Media Entertainment and Arts Alliance (MEAA), including for the purpose of calculating and paying residuals to on-screen talent.

We may provide your contact details to a third party business we engage to manage our other production or marketing services.

We may also disclose collected personal information in confidence to a third party who expresses interest in purchasing our business or in the event we propose to sell our business or for the purposes of merger or re-organization.

Personal information provided to a Company may be shared with other related companies within ‘the Company group’ and used and disclosed for the above purposes by such companies.

Company productions are intended to be marketed throughout the world and in the course of financing, licensing and distributing our productions we may need to provide personal information about our cast and crew to our distributors, broadcasters and sales agents, including contact details and contractual entitlements.

Your right to access to personal information and to request corrections

Should you wish to access or correct personal information that we hold about you, please make a written request to our Privacy Officer (contact details are set out at the end of this Policy).

It is your right to request access to your personal information held by us.  Situations where we may need to refuse to give you access include where legal proceedings have been commenced or are anticipated. You also have the right to request corrections to personal information about you if it is inaccurate, including if it is out of date. Our Privacy Officer will endeavor to resolve any disputes regarding whether your personal information that we hold is correct.

We will seek to respond to your written request within 14 days of its receipt. Company may charge a fee, as appropriate, in certain circumstances in order to facilitate access to your personal information. No fee is charged to correct personal information.

Changes to this Policy

Company may update this privacy policy from time to time. The revised policy will be posted on our website.

If you have a complaint

We encourage you to contact us if you have any concerns about the use of your personal information. If you believe we have breached the Australian Privacy Principles please contact our Privacy Officer (contact details are set out below). All complaints will be considered by the Privacy Officer who will endeavor to resolve the matter with you. If the complaint is not satisfactorily resolved the complaint may be taken to the Office of the Australian Information Commissioner (Ph: 1300 363 992; GPO box 5288 Sydney NSW 2001).  Further information about lodging a compliant is available on the website of the Office of the Australian Information Commissioner.
